Chippewa Valley Technical College Workforce Solutions & Continuing Education Services Contract Terms & Conditions
CVTC provides the following guidelines regarding contracting services through the Workforce Solutions & Continuing Education division of the College. CVTC is a part of the Wisconsin Technical College System, and as such, is granted the ability to provide employer services of this nature via Wisconsin State Statute 38.14.
CONTRACT
The signed Contract for Service Agreement is required to be signed and returned to CVTC no later than two weeks prior to the start of the contract in order for services to be rendered. Services (i.e. training and technical assistance) cannot take place without a signed contract in place.
CONTRACT RATES
The published hourly contract rate applies unless there are more than the maximum students in attendance within the training program. If the number of students exceeds the maximum, a per person “Tuition and Material Fee” will be assessed in accordance with the Wisconsin Technical College System mandates.
MULTIPLE COMPANY CONTRACTS
If this proposal is a multiple company contract, pricing for each company is determined by final, guaranteed participant numbers. A decrease in numbers for one company, will result in an increase for the remaining companies’ pricing.
In addition, each company is responsible for the costs as quoted in this document or number of participants if it is greater, unless communication of any changes to the number of participants or other changes are discussed with CVTC within 48 hours of the delivery of service.
LUMENS REGISTRATION
In order to ensure that credit is properly applied to student transcripts, all students must be registered by the contracting employer ahead of the training via the CVTC online registration system, Lumens. This can be completed at cvtc.augusoft.net. Please call 715-874-4676 for assistance in accessing your company account or registering your employees for this training. Registration of employees must be completed one week prior to the start of the contract.
SUPPLIES
For training that requires the ordering of supplies, the final confirmed attendee headcount will be used when ordering.
- Should the number of anticipated attendees change after this time to a lesser amount, and the order has been placed, the supplies ordered will be billed to the customer at the original guaranteed number. This is due to the inability, in most cases, to return materials after the order has been placed and received, thereby incurring an expense. If the order has not been placed, every effort will be made to lower the quantity to the new number.
- Should the number of anticipated attendees change to a larger number after this time, we are glad to increase the order provided there is enough lead time to order, ship, and receive the materials ahead of the actual date of training. If the timeframe is short, we are happy to order and provide you with the additional materials after the date of the training.
- Price increases of materials will be the responsibility of the customer, as CVTC cannot control or estimate for this.
NO SHOWS
CUSTOMER LACK OF COMMUNICATION IN CANCELLING A CLASS/CONTRACT
It is important that CVTC be notified if a cancellation needs to occur. The customer is responsible for contacting CVTC about cancelling. If it is not communicated that they wish to cancel a class/contract, the customer will be billed for the original pricing. This is due to the fact that the instructor prepared, traveled and planned to deliver a service.
CANCELLATION
CUSTOMER INITIATED CANCELLATIONS
There will be no charge for a one-time cancelation of a contract if it is rescheduled to run within 90 days of the original date. If the same contract is canceled a 2nd time prior to delivery, additional charges may apply.
CVTC INITIATED CANCELLATIONS
CVTC Workforce Solutions & Continuing Education makes every effort not to cancel a schedule training event. In rare occasions, an instructor/trainer illness, a personal emergency or an extreme weather situation could occur causing a cancellation. We will inform you as soon as a cancellation is necessary and will make every effort to reschedule the class at a convenient time for the company.
LIABILITY
For Technical Assistance Contracts: Notwithstanding any other provision of this agreement, neither the college nor the instructor shall be liable to client for any special, indirect, incidental, exemplary, or consequential damages, loss or profits or loss of goodwill resulting from, or relating to, the services provided under this agreement and/or the negligence of the college or the instructor. The sole and exclusive remedy available to the client for a breach of this agreement or any other claim or cause of action related to the provision of services pursuant to this contract shall be limited to the recovery of actual damages, which in no event shall exceed the amounts paid to the college or the instructor under this agreement.
The services provided by CVTC are considered instructional and advisory. The employer customer is responsible for compliance with local, state, federal regulations and for providing and implementing a safe work environment.
MATERIALS/COPYRIGHTS
Materials developed will be property of Chippewa Valley Technical College unless otherwise stipulated. Photocopying, reproduction of training content, videotaping, teleconferencing, or any other viewing of materials are prohibited without prior approval of CVTC. Chippewa Valley Technical College employees performing under the contract remain under the exclusive control of the same.
